Terms of Use
Effective date:
These terms apply to the RxPortal website and to RxPortal accounts. They are an agreement between you and Pharmvisory LLC (“we”, “us”). Questions: [email protected].
Accepting these terms
By using the website or signing in to RxPortal, you agree to these terms and to our Privacy Policy. If you use RxPortal for a pharmacy or practice, you confirm you are allowed to accept these terms for it. A pharmacy’s written agreement with us, if it has one, takes priority over these terms where they differ.
Who may use RxPortal
RxPortal accounts are for adults 18 or older who are one of the following:
- Licensed prescribers whom a pharmacy has invited or approved.
- Staff of a pharmacy that uses RxPortal, with that pharmacy’s authorization.
You must give accurate information, including your professional credentials and license details, and keep it up to date. A pharmacy decides whether to approve, suspend or disable accounts on its portal.
Your account and its security
- Keep your password and second sign-in step to yourself. Do not share your account.
- Two-step sign-in (an authenticator app or a passkey) is available, and we recommend turning it on. It is not currently required.
- Sign out on shared computers.
- Tell your pharmacy and us right away at [email protected] if you think someone else has used your account.
You are responsible for what happens under your account until you tell us it may be compromised.
Acceptable use
You agree not to:
- Use RxPortal for anything unlawful, or for prescriptions you are not authorized to write or fill.
- Enter information you know is false, or another person’s credentials or signature.
- Try to reach data belonging to another pharmacy, prescriber or patient that you are not authorized to see.
- Probe, scan or test RxPortal’s security without our written permission, or get around its security or rate limits.
- Upload malicious code, or overload or disrupt the service.
- Copy, resell or reverse engineer RxPortal, except as the law expressly allows.
- Put patient information in places not meant for it, such as support requests or bug reports.
RxPortal is software, not medical advice
RxPortal is software for pharmacy catalogs, prescriber accounts and, in future, prescription orders. It does not provide medical, pharmacy or legal advice, and it does not make clinical decisions. Nothing in RxPortal replaces the professional judgment of prescribers and pharmacists.
RxPortal does not convert units, substitute products or check doses, interactions or allergies. Prescribers are responsible for what they prescribe, and pharmacies for what they compound and dispense.
Your regulatory responsibilities
You remain responsible for your own compliance with the law, including:
- Federal and state rules on prescribing, compounding and dispensing.
- DEA registration and requirements, and state board of pharmacy and medical board rules.
- Valid prescriber-patient relationships and prescription requirements in your state.
- Your own HIPAA and privacy obligations to patients.
RxPortal is not designed for controlled substance (Schedule II to V) electronic prescribing. Do not use it to send those prescriptions.
No payments
RxPortal does not take or process payments of any kind. Prices shown in a pharmacy’s formulary come from that pharmacy and are for reference only. Billing, if any, is between you and the pharmacy, outside RxPortal.
Availability
We work to keep RxPortal available, but it is provided “as is” and “as available”. It may be interrupted for maintenance, updates or reasons outside our control, and features may change. Keep another way to send and receive urgent prescriptions.
Disclaimers
To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that RxPortal will be uninterrupted, error-free or completely secure. Some states do not allow some of these exclusions, so they may not all apply to you.
Limitation of liability
To the fullest extent the law allows, Pharmvisory LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of RxPortal or the website. Our total liability for any claim relating to RxPortal or these terms is limited to one hundred US dollars (US$100). These limits do not apply where the law does not allow them, such as for liability that cannot be limited for gross negligence or willful misconduct.
Indemnity
Each pharmacy or practice that uses RxPortal agrees to defend and indemnify Pharmvisory LLC against claims, losses and costs (including reasonable attorneys’ fees) that arise from misuse of RxPortal by that organization or its users, a breach of these terms by them, or the organization’s prescribing, compounding or dispensing decisions. This obligation belongs to the organization, not to individual prescribers or staff members personally.
Ending your use
You may stop using RxPortal at any time; ask your pharmacy or email us to close your account. A pharmacy may disable accounts on its portal. We may suspend or end access if you break these terms, if the law requires it, or to protect patients, pharmacies or RxPortal. Records may be kept after an account closes as described in our Privacy Policy. The sections on medical advice, responsibilities, disclaimers, limitation of liability, indemnity and governing law continue to apply after your use ends.
Governing law and where disputes are heard
These terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Any dispute relating to these terms or RxPortal will be heard only in the state or federal courts located in Utah, and you and we agree to those courts’ jurisdiction.
Changes to these terms
We may update these terms. We will post the new terms here with a new effective date. For material changes, we will give notice by email or in the portal before they take effect. Using RxPortal after that means you accept the updated terms.
Other terms
If part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent.
Reporting a security problem
If you find a security problem in RxPortal, please report it to [email protected]. Give us a reasonable chance to fix it before telling others, and do not access data that is not yours while checking.
